CelcomDigi x Mesra Loyalty Programme Promotion Terms and Conditions

1. The Organiser:

   Digi Telecommunication Sdn. Bhd. [Company Registration No.: 199001009711 (201283-M)] (“Digi”) and Petronas Dagangan Berhad [Company Registration No.: 527213P ] (“PDB”) are the joint organiser of this “CelcomDigi x Mesra Loyalty Programme Promotion” (“Promotion”).
   
   (Digi and PDB shall hereafter be collectively referred to as “the Organiser”).

2. Promotion Eligibility

   This Promotion is open to customers/participants (“the Participant”) who fulfil ALL the below requirements:

   1. A registered and active Petronas Mesra card member who either has a physical Mesra card and/or virtual Mesra card on the Setel Mobile Application (“Setel App”) or Setel website at http://www.setel.com;
   2. Holding Malaysian citizenship; and
   3. Aged eighteen (18) and above.
   
   By participating in this Promotion, the Participant hereby agrees to be bound by these terms and conditions which shall form an integral part of and to be read together with the relevant terms and conditions of the respective mobile/content service(s) offered relevant to the Participant in respect of this Promotion as published at [XX] respectively.
   In the event of a conflict or inconsistency between these terms and conditions and the terms and conditions of the respective mobile/content service(s), such inconsistency shall be resolved by giving precedence in the following decreasing order (i) these terms and conditions (ii) the terms and conditions of the respective mobile/content service(s).

    

3. Promotion Period

   This Promotion shall commence from (01.09.2023) until (01.12.23) and shall continue until further notice issued by the Organiser (“Promotion Period”). Any extension or discontinuation of this Promotion shall be at the sole discretion of the Organiser.,

4. Promotion Mechanics
   1. Discounted Plans – discounted mobile or internet plans for new customers or as part of special promotion. These can include reduced monthly fees, data bonuses, or free calling minutes.
   2. Bundle Deal – CelcomDigi may bundle services like mobile and internet into one package at a reduced cost compared to subscribing to each service separately.
   3. Contract Length - Some promotions require customers to sign a contract for a specific duration, typically 24 months, to be eligible for the discounted rates.
   4. Limited-Time Offers - CelcomDigi frequently run limited-time promotions, encouraging customers to sign up or upgrade within a specific timeframe to avail of the benefits.
   5. Device Discounts - When customers purchase a new smartphone or other devices through the telco, they may receive discounts or installment payment options.
5. Personal Data
   When engaging in the Promotion, the Participant is considered to have acknowledged and provided the Participant’s agreement and approval to the Organiser’s collection, processing, utilisation, disclosure, and retention of the Participant’s personal data, in accordance with the guidelines specified in the Personal Data Notice outlined under Section 7 of the Personal Data Protection Act 2010. This notice is accessible for viewing at www.mymesra.com.my/pdpa.
6. General Terms and Conditions
   1. The Organiser reserves the sole and absolute right to withdraw, amend, omit and/or vary any part or the whole of the terms and conditions of this Promotion without prior notice to the Participant and the Participant shall be bound to observe, perform and comply with the terms and conditions herein and any amendments thereof.
   2. The Participant acknowledges and agrees that the Organiser reserves the right to disqualify any participation if the Participant is in breach of its obligations or any terms and conditions of this Promotion. Notwithstanding the above, the Organiser reserves the right to reject any participation at its sole and absolute discretion without having to assign any reasons whatsoever.
   3. If at any juncture during or following the Promotion Period, the Participant is determined to be ineligible, the Organiser shall retain the exclusive right to, at its discretion, disqualify the Participant and retract/cancel any items/products procured by them. Should the Participant have utilised or experienced the items/products, the Participant hereby consents and commits to indemnify the Organiser for the expenses related to these items/products. In such instances, the Organiser reserves the authority to take any requisite measures against the said Participant.
   4. The Organiser’s decisions in any matter in relation to this Promotion shall be final and conclusive. Any request for appeal and review shall not be entertained.
   5. The Organiser shall not be liable for any claim by the Participant or third-party claims or loses of any nature, including but not limited to, loss of profits, punitive, indirect, special, incidental or consequential damages or for other damages and any related claims of any nature, including direct, indirect, third party, consequential or other damages resulting from or in connection with this Promotion.
   6. The Organiser disclaims any and all liability for loss or damage to property or any personal injury or loss of life resulting from or in connection with this Promotion.
   7. The Organiser does not take any responsibility in the event any Participant is prevented from participating in this Promotion, as a result of certain technical restrictions or other limitations or force majeure which include but not limited to regulatory and/or government directive, act of God etc.
   8. Except as expressly mentioned herein, the Organiser shall not be responsible for any expenses and costs including out-of-pocket expenses related to or as a consequence of participating in this Promotion.
   9. In the event any of these terms and conditions is invalid, illegal and unenforceable under any applicable law or by any reasons whatsoever, the legality and enforceability of the remaining provisions shall not be affected.
   10. No delay or indulgence by the Organiser in enforcing any terms or conditions herein shall constitute a waiver by the Organiser of the Participant’s breach of these terms and conditions.
   11. The terms and conditions herein shall be construed and governed by the laws of Malaysia. In case of a dispute, the courts of Malaysia shall have exclusive jurisdiction.
